Mpower started as an ambitious dream. Then, it became a solemn vow. Now, it is a passionately on-going endeavour to be the Movement to affect change; to promote mental health and well-being in the most holistic manner conceivable. We empower individuals and their families from all walks of life by creating awareness, fostering education and alleviating stigma vis-à-vis mental health. Mpower App Privacy Policy

Your privacy is important to us and Mpower, an initiative of Aditya Birla Education Trust (‘MPower’ or ‘Trust’), is committed to protecting the same. We have adopted the following Privacy Policy, which is applicable to all personally identifiable information (‘PII’) that you provide to Mpower through https://mpowerminds.com/ (the "Website"). You must also review and accept our Website Terms of Use as it is also applicable and govern your use of the Website.

This Privacy Policy does not apply to any PII that you may provide to third parties (including the Aditya Birla Group Entities), such as through other sites linked to the Website. Please be aware that if you choose to visit such third-party sites, you should contact such third parties directly to determine their respective privacy policies because that third party's privacy policy and not our website’s will govern your activities and any PII you disclose while visiting the third-party site.

This privacy policy explains the purposes for which Mpower processes your PII through its Website.

PURPOSE OF COLLECTION AND PROCESSING

We may collect your title, name, gender, date of birth, email address, mobile number, location, and other personally identifiable information that you submit on the Website ("Personally Identifiable Information") to provide you:

  • a smooth, efficient and customized experience;
  • to enable MPower to reach out to you to provide services;
  • to enable us to improve products & services;
  • to process your requests (such as replying to your queries or complaints);
  • to drive marketing campaign, promotional communications for which you have consented;
  • to protect our vital interest

The PII collected for the aforesaid purposes will not be posted in areas of the Website viewable by the public or users of the site.

How We Collect Your Personal Data:

We collect Data in the following ways:

MPower may collect your PII in several ways from your use of this Website, for instance:

  • Our web servers or affiliates who provide analytics and performance enhancement services collect IP address, operating system details, browsing details, device details and language settings. This information is aggregated to measure the number of visits, average time spent on the site, pages viewed and similar information. MPower uses this information to measure the site usage, improve content and to ensure safety and security, as well as enhance performance of the Website.

TRANSFER OF PERSONALLY IDENTIFIABLE INFORMATION

The PII that we collect from you may be transferred to and stored at locations that may or may not be in India. It may also be processed by staff operating outside the territory of India, who work for or are engaged by MPower.

PARTNER

To enable us to provide you with an enhanced and secured user experience, we may enter into contracts with various third-party vendors from time to time. Such engagement may involve sharing your PII. To the extent a third party has access to your PII, we will ask them to treat it at least as protectively as they treat personally identifiable information they obtain from their other authorized sources. We do not market or sell your personal data to any third party.

DATA RETENTION POLICY

We will retain data for a reasonable time (“Data Retention Period”) that may be varied for different users as may be statutorily required to be maintained as per applicable law or arising out of legitimate purposes. We shall take reasonable steps to destroy or permanently de-identify PII that is no longer needed, including that processed by third-party vendors engaged by MPower from time to time.

CHANGING YOUR PERSONALLY IDENTIFIABLE INFORMATION

MPower gives you the ability to edit your PII at any time; a request thereto should be made at Mpower.piidatadelete@abet.co.in. We will, however, retain in our files and databases PII you have requested to remove in order to use it in some circumstances, such as to resolve disputes, troubleshoot problems, and enforce our Terms and Conditions of Use. Further, such prior PII is never completely removed from our databases due to technical and legal constraints, including stored "backup" systems. Therefore, you should not expect that all of your PII will be completely removed from our databases in response to your requests.

REGULATORY OBLIGATIONS

Due to the existing regulatory environment, we cannot ensure that all of your Personal Information will never be disclosed in ways not otherwise described in this Privacy Policy. By way of example (without limiting the foregoing), we may be required to disclose your PII to the government, law enforcement agencies, etc.

DATA SECURITY

To protect your privacy and security, we will also take reasonable steps to verify your identity before granting access. DISCLAIMER

To protect your privacy, as stated above, we will take best efforts and adopt best Industry Standards Information Practice, however, you understand that 100% security does not exist over the internet. You are responsible for protecting your PII and you should not share your login credentials and/or leave your personal devices unattended while you are accessing the Website, etc. MPower does not guarantee and you should not expect in the event of malware attack or negligence on your part that your Personal Information will remain private.

YOUR CONSENT

By accepting this Privacy Policy and our Terms, you expressly consent to our use and disclosure of your Personal Information in the manner prescribed in this Privacy Policy. By accessing or using the website or by otherwise giving us your information, you confirm that you have the capacity to enter into a legally binding contract under Indian law, in particular, the Indian Contract Act, 1872, and have read, understood, and agreed to the practices and policies outlined in this privacy policy and agree to be bound by the privacy policy. In the event that you are a minor using the website, it is assumed that you have obtained the consent of your legal guardian or parents and such use is made available by your legal guardian or parents. We will not be responsible for any consequence that arises as a result of misuse of any kind of our platforms or any of our services or products that may occur by virtue of any person including a minor registering for the services/products provided. By using the services, you warrant that all the data provided by you is accurate and complete and that the student using the platforms has obtained the consent of a parent/legal guardian (in case of minors).

RIGHTS UNDER APPLICABLE LAWS

We are processing your personal data based on the consent you have provided by accepting this Privacy Policy. We acknowledge your right to access, rectification, erasure, restriction of the processing, data portability, and object to the processing of your personal data. However, these rights are not absolute in nature and are subjected to contract, applicable legislation, record-keeping requirements under applicable statutes, ongoing disputes, or potential disputes Mpower may foresee. In the event of any misconduct/fraud/cybercrime, etc. on your part, Mpower shall be at liberty to use your PII as evidence in the Court of law and shall also be entitled to carry out investigations/inquiries as it deems fit with the help of private agencies or authorities as it deems fit. By you consenting to this Notice, you agree to the sharing of your PII for the aforesaid purposes and understand that exercise of your rights to that extent shall be restricted.

Account Deletion Policy

1. Account Deletion Process:

  • Users can delete their account within the mobile app by accessing the “More” tab and selecting the "Delete Account" option.
  • Upon initiating the account deletion process, users will be prompted to confirm their decision. Once confirmed, the account deletion request will be processed.
  • Temporary Account Deactivation, freezing, disabling the Account on the App shall not be termed or qualified as “Account Deletion”.

2. Implications of Account Deletion:

  • Once an account is deleted, users will no longer be able to log in to the app using the same credentials (mobile number & email address).
  • However, it's important to note that certain data associated with the deleted account may be retained for internal business purposes. This includes aggregated usage statistics and anonymized data used for analytical purposes.

3. Data Retention:

While a user’s account is deleted from the app upon account deletion by him/her, certain data may be retained for internal business use under the information of the user and with his/her consent as stated in and in accordance with our data retention policy. This includes aggregated usage data and anonymized information used for analytics and improving our services. However, personally identifiable information associated with deleted accounts may not be retained.

OTHER TERMS AND CONDITIONS

The following (read along with the full terms and conditions sent to you vide our confirmation email) forms the legal understanding ("Terms") between Aditya Birla Education Trust hereinafter referred as "Mpower" (and which expression shall mean and include its trustees, officers, employees, agents or any of its representatives) and the Client/NR:

2. The Client/NR represents that Clienvt: is above the age of 18 years; and

(b) understands and agrees to the Terms.

3. Crisis:

Mpower is not a crisis centre and has finite operating hours. If the Client's situation involves a life-threatening emergency and/ or requires urgent physical care, the Client must visit a hospital for assistance.

4. Client Sessions, Records, and Confidentiality:

Clients/NRs are required to present a photo ID of the Client, of which a photocopy will be taken for Mpower's records, before starting the screening session. "Client Information" means all information provided by the Clients/NRs to Mpower and/or the Therapist/Psychiatrist, including all medical health records, personal information, sensitive information, records of the sessions, and any communication between the Therapist/Psychiatrist and the Clients/NRs. Written documentation of Client Information includes a referral form, notes from initial screenings, a provisional diagnosis, a treatment plan, goals and recommendations, and progress notes for every visit.

The Clients/NRs consent to the use and retention by Mpower of Client Information.

Mpower will take best efforts to keep Client Information, including communication between the Client and Therapist/Psychiatrist at Mpower during the session confidential. The Clients/NRs are entitled to access Client's basic medical health record (which includes demographic information, diagnosis, and treatment plan) by requesting it in writing from Mpower. Subsequent details and further records will be given as per needs of appropriate legal directives at that time.

Mpower may retain Client Information for the purpose of analysis and research. Our professionals may internally share certain Client Information for therapeutic purposes, clinical purposes, intern education, data analysis, or for research purposes, as well as during multidisciplinary meetings.

Confidentiality is of utmost importance whilst sensitively dealing with each of our Clients/NRs and their families. However, disclosure of Client Information is mandatory in the event of any perceived risk to the Client or from the Client, or for any reason as may be necessary to disclose by law.

Mpower does not permit the audio and/or video recording of any Service at the Centre.

5. Length and Frequency of Visits:

The length of the first screening intake session is up to 90 minutes. The standard length of subsequent ongoing sessions is 45 minutes. To avail of the Services for more than 45 minutes, Client/NR will be required to book a separate appointment for a new session and will be charged accordingly.

Frequency of sessions is decided according to the needs and the unique situation of each Client. We generally suggest starting counselling with regular weekly appointments. Once some progress has been made, visits may be less frequent and spaced out over a larger period of time.

6. Being Late for a Session:

If the Client arrives late for an appointment, the duration of the appointment may be shortened by the amount of time the Client came in late. When the Client arrives, the Therapist/Psychiatrist will make use of the time that is available, and may not be able to extend the session time due to the next Client's appointment or other time commitments.

7. Payment

Client/NR is expected to pay the standard fee before each session, unless other arrangements have been made in advance. There is an option of making the payment by cash, credit card, or e-transfer. Mpower does not offer refund of any payment made by Clients/NRs. Failure to make a payment will result in suspension of Services until the balance is paid in full. Mpower shall not be entitled to refund or repay any amount to the Client/NR paid towards Client's treatment opted under a package, in case the Client discontinues with the treatment without completing the entire course of the package/sessions.

Home visits are charged differently than appointments for sessions at Mpower. Please inquire about home visit charges at the Front Desk.

8. Insurance:

Mpower does not have a cashless facility and therefore does not provide direct billing; however, receipts can be provided so that Clients/NRs may submit their claim for reimbursement from their respective insurance providers. If the insurance provider requires clinical notes, the Client/NR will be asked to sign a 'Disclosure Consent Form' to disclose information.

9. Cancellation Policy and Missed Appointments:

Clients/NRs are requested to inform Mpower at the earliest if they are unable to keep an appointment. An appointment time is especially reserved for the Client; therefore, Mpower requires an advance notice of at least 24 hours for cancellations or changes of scheduled appointments. If an appointment is cancelled with less than 24 hours' notice, or if the Client fails to show up, the Client/NR will be charged for the appointment.

Unusual exceptions may be considered.

In the event of any natural disasters or other emergencies, Mpower may cancel any or all scheduled appointments by informing the Client/NR via email, message, or phone call. However, the Client/NR will not be charged for such cancellations.

10. Right to Deny Service:

Mpower reserves the right to deny or discontinue Services with the Client, in case the Client and/or parent/guardian/NR misbehaves or misconducts or mistreats any personnel of Mpower or any person/staff associated with Mpower or creates an unhealthy atmosphere in the vicinity of Mpower which is likely to affect the goodwill of Mpower.

Mpower may cease to provide Services to the Client, if a referral is made to inpatient treatment by Mpower Therapist/Psychiatrist, and the Client/NR refuses that referral. Mpower may also cease to provide Services to the Client if Services at Mpower are deemed non-beneficial to the Client by Mpower Therapist/Psychiatrist for any particular reason.

The Client acknowledges that referral to Mpower can be made by parents/guardians/NRs, general practitioners or any other caregivers of the Client.

The Client/NR agrees that the Client Information, including any personal information or sensitive personal information as provided by the Client has been submitted in the registration form with the

Client/NR's express consent.

The Client/NR has expressly given consent without having been subjected to coercion, undue influence or intimidation to undertake treatment at Mpower, after adequately understanding and considering the information and procedure for undergoing treatment along with an understanding of anticipated risks involved, if any. Hence, the Client/NR shall not hold Mpower liable for any act or omission which shall directly or indirectly affect the health of the Client. The Clients/NRs agree to defend, indemnify and hold harmless Mpower, from and against all liabilities, claims, or losses, and acknowledge that M ower cannot be held liable for an claims, arisin out o use of the Services, violation ofthe Terms or violation of an third party right.

These Terms shall be governed by the laws of India and any disputes arising out of the Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai.

I hereby declare that all information or details provided by me are accurate/ rified and true to the best of my knowledge. I also give my consent to the Mpower professionals to use this information for therapeutic assessments and intervention in the best interest of the Client.

I hereby consent to be governed under and construed by the Laws of the Republic of India and to the exclusive jurisdiction of the courts in Mumbai concerning the services from Mpower - The Centre or any matter there to or incidental thereto.
